New York State Employers
Employers in New York State must provide their employees with sexual harassment prevention training. Training must be conducted annually and must include exempt, non-exempt, part-time workers, and temporary workers. Our training complies with the following requirements:
- Explanation of what constitutes sexual harassment
- Examples of conduct that would constitute unlawful sexual harassment
- Information concerning federal and state statutory provisions concerning sexual harassment and remedies available to victims of sexual harassment
- Information concerning employees’ rights of redress and all available forums for adjudicating complaints
- Information addressing conduct by supervisors and any additional responsibilities of such supervisors
New York City Employers
Businesses located in New York City employing 15 or more employees must provide compliant sexual harassment prevention training. Full-time and part-time employees as well as interns must be trained. New hires must be trained within 90 days of hire. Our training complies with the following requirements:
- An explanation of sexual harassment as a form of unlawful discrimination under local law
- A statement that sexual harassment is also a form of unlawful discrimination under state and federal law
- A description of what sexual harassment is, using examples
- Any internal complaint process available to employees through their employer to address sexual harassment claims
- The complaint process is available through the Commission, the New York State Division of Human Rights, and the United States Equal Employment Opportunity Commission including contact information
- The prohibition of retaliation including examples
- Information concerning bystander intervention
- Specific responsibilities of supervisors and managers in the prevention of sexual harassment and retaliation, and measures to appropriately address sexual harassment complaints.
